Walking in a Winter Wonderland

The Farmers’ Almanac is predicting that 2018 is going to be a very snowy year in Massachusetts. While that may be great news for snowboarders and snowmen-builders, it could be treacherous for residents just trying to get through it to run errands or visit a friend.

If You Are Injured in a Park or Lake, Who Is Responsible?

A 21-year-old man from Ghent, N.Y., was hiking with his girlfriend when he slipped on a rock and was sent falling to his death below a waterfall at Bash Bish Falls in Mount Washington. Days later, his body was located through the use of an underwater camera; however, Berkshire District Attorney David Capeless initially determined that the body was unrecoverable based on the location. After several days, the body ultimately was retrieved from a crevice beneath the water.

Safety Starts At Home

Understanding Massachusetts Slip & Fall Premises Liability Law
During the holiday season, the winter weather creates possibly dangerous surface conditions. Snow and ice can make sidewalks, parking lots, entryways, and flights of stairs potential settings for injuries. Those who own, control, or possess property can be subjected to civil liability when other parties are harmed within their property. This liability can apply to an owner of uninhabited land, to residential property owners, as well as businesses. In Massachusetts, such cases are heard by the District Courts if the monetary damages are unlikely to exceed $25,000, or the Superior Courts if likely to exceed that threshold.
Why your Slip and Fall is Not as Innocent as You Think
Slipping and falling in a grocery store, workplace, or retail store may seem innocent. The fall is innocent until the pain becomes a serious injury, such as a broken bone, that leads to life long repercussions.

Winter in Boston Means Increase in Personal Injury Accidents
It’s common to see snow or ice-covered staircases this time of year. Most people do their best to clean their properties and keep thoroughfares safe. However, there are occasions when Massachusetts property owners fail to exercise their due diligence. Perhaps they waited too long to clear the area or didn’t clean it well enough. Maybe they forgot to install or maintain a proper handrail.
Slip and Fall Accidents and Massachusetts Legal Issues
Slip and fall accidents are usually something one would consider to be a problem only business owners face. However, in the state of Massachusetts, there are actually laws in place that every property owner should be aware of. These rules are also something that someone should understand if they suffer a slip and fall accident. For these reasons, learning more about these rules is an important part of remaining compliant in the event of one of these types of accidents.

Simply put, premises (a rented apartment or a commercial establishment are examples) must be well maintained, so they are safe to use and will not cause an accident.
