Liability for New Hampshire Boiler Explosions
Property owners in New Hampshire have a legal obligation to maintain their premises in a reasonably safe condition. When a property owner has actual or constructive notice of a dangerous condition with their property, they must take action. If a property owner fails to take action to protect against a dangerous condition, this could form the basis of a negligence claim. Property owners in New Hampshire should take several measures to prevent accidents.
- Regular Inspections: Property owners should conduct regular inspections of their property to uncover latent hazards.
- Repairs: Property owners should work to repair any hazardous conditions after they become aware of them.
- Training: Employers should train staff to follow certain safety measures to prevent hazards from occurring.
Boilers can be particularly dangerous. This equipment can explode in certain conditions. For example, a boiler may have faulty low-water cutoffs. A boiler may also have fatigue cracks from years of constant use. The circumstances surrounding any explosion should be carefully examined. They could reveal several liable parties, including the company that manufactured the boiler.
Steps to Take After New Hampshire Boiler Explosions
Many people are seriously injured or killed in boiler accidents each year. According to Safety Now, “Tragically, a total of 127 people have lost their lives as the result of boiler and pressure vessel accidents. Of the 23,338 accidents, 83 % were a direct result of human oversight or lack of knowledge (i.e., low-water condition, improper installation, improper repair, operator error or poor maintenance).” Victims of boiler accidents should take certain measures to protect their health and legal rights.
- Hospital Visit: Any person injured in a boiler explosion should seek medical care. It is relatively common for people to skip out on medical care if they feel all right after an accident. But certain injuries may not be immediately obvious.
- Evidence Preservation: All of the evidence related to the explosion should be carefully preserved. This should include the boiler itself and any maintenance records associated with that unit.
- Legal Support: Victims of boiler explosions should carefully consider their options with an experienced Boston personal injury attorney. An attorney can examine the unique facts of your case free of cost and let you know how much compensation you may be entitled to.
Boiler explosions are often highly preventable. They tend to involve clear safety lapses. The victims of these explosions tend to suffer very serious injuries. In particular, burn injuries often required painful skin graft surgeries. It is important that affected parties understand that they do have legal options. They are able to seek some measure of accountability and justice through a personal injury claim.
