Liability for Canton Construction Accidents
When a construction worker is injured in Massachusetts, they will typically have recourse through the workers’ compensation system. The workers’ compensation system in Massachusetts operates through a no-fault insurance scheme. There’s no need for an injured worker to demonstrate one or more parties was negligent. In addition to workers’ compensation, an injured worker may also be able to file a personal injury claim against third parties separate from their employer. There could be numerous sources of third party liability for any construction accident.
- Defective Equipment: The company that manufactured equipment used for a construction site could potentially be held liable through a product liability claim. Under a strict liability claim, it is not necessary to demonstrate that the manufacturer was negligent.
- Contractors and Subcontractors: Construction projects are typically made up of a blend of different contractors and subcontractors who work together. If the actions of these parties are deemed negligent, they could also be held at fault. For example, they may have ignored weight limits or removed safety covers.
- Property Owners: The entity that maintained or controlled a construction site could also be liable for an accident if it was in an unsafe condition. This could include situations where there are slippery surfaces or insufficient safeguards.
It is important that evidence is properly preserved after any construction accident. Evidence can help reveal what may have contributed to some particular incident. The majority of construction accidents are preventable. They tend to involve situations where construction companies ignore safety standards. Having experienced legal counsel in these situations is critical. An attorney can evaluate how an accident took place and help identify all potentially liable third parties.
Steps to Take After a Construction Accident
Any type of “struck-by injury” can have devastating consequences. According to the Centers for Disease Control, “Struck-by injuries occur from violent contact or impact between an object or piece of equipment and a person. Struck-by injuries can be fatal, and even when a worker is not seriously injured can result in days off work to recover.” Injured workers should take several steps to preserve their financial interests and legal rights.
- Medical Evaluation: Workers should seek a thorough medical evaluation, even if they feel as though their injuries are not that significant. Any type of injury to a person’s back or head can cause long-term problems down the road.
- Report the Accident: Workers should report the accident to their employer as soon as possible. There should be a clear record of what happened and when it happened.
- Seek Legal Support: Workers should seek the guidance of an experienced Boston construction accident attorney. An attorney can take steps to ensure that your rights are being protected and that you are fairly compensated for your injuries.
A serious construction accident can completely upend a person’s life. They may need to take extensive periods of time away from their profession. In many cases, they will be unable to return to their previous job duties. It is essential that any person injured at their job in Massachusetts fully understand all of their legal options. Victims can seek aid through a workers’ compensation claim and a personal injury lawsuit.
