Dario Espinoza Pomaquiza Died in Danvers Construction Accident After Falling From Home on Briarwood Drive

DANVERS, MASSACHUSETTS (January 23, 2026) – A roofer identified as Dario Pomaquiza has tragically died after falling from the roof of a home in Danvers along Briarwood Drive.

Essex County officials are saying that the accident took place around 8:15 AM on January 7th. Dario Pomaquiza was working on the roof of the home when he fell for some undetermined reason.

Paramedics were called to the scene of the accident to help the victim. Dario Pomaquiza was transported to Beverly Hospital with major injuries.

Despite treatment at the hospital, he was later pronounced dead. A full investigation by the Occupational Safety and Health Administration (OSHA) remains ongoing at this time.

Liability for Danvers Roof Fall Accidents

Employers have a legal obligation to maintain worksites in a reasonably safe condition. According to 29 U.S.C. § 654(a)(1), “each employer shall furnish to each of his employees employment and a place of employment which are free from recognized hazards that are causing or are likely to cause death or serious physical harm to his employees.” Several steps should be taken to prevent roof fall accidents.

  • Barriers: Employers may need to install guardrails and other protective measures at certain locations.
  • Fall Protection: Workers should be provided with personal fall arrest systems when they’re working at heights of 6 feet or higher.
  • Training: Employers should provide all of their workers with adequate training and supervision. This includes training workers to recognize fall hazards.
  • Environmental Concerns: Workers should not be allowed to continue during high winds, rain, ice, or other hazardous weather conditions.

When workers are injured in Massachusetts, they or their surviving family members will typically have recourse through the workers’ compensation system. This is a no-fault insurance scheme designed to help injured workers and their families. An injured worker may also have recourse through a third-party liability claim. For example, a general contractor could be liable for an accident if they failed to maintain a safe worksite or did not provide workers with adequate fault protection.

Steps to Take After Danvers Construction Accidents

Falls remain a leading cause of preventable injury and death for workers in the construction industry. According to the Bureau of Labor Statistics, “In 2023, about 1 in 5 (20.8 percent) workplace deaths occurred in the construction industry and 38.5 percent of these deaths were due to falls, slips, and trips. The construction industry accounted for 47.8 percent of all fatal falls, slips, and trips in 2023.” It is important that certain actions are taken after any roof fall accident.

  • Victims should seek medical treatment as early as possible.
  • Photos of the accident site should be taken. They can help reveal a dangerous condition that may have contributed to the accident.
  • Any person that may have witnessed the accident should be interviewed as soon as possible while their memories are still fresh.
  • Any person injured in a construction accident should seek a legal review of the incident with the team experienced in tort claims.

Roof fall accidents are typically very preventable. They tend to be the results of clear safety lapses and OSHA violations. In many of these incidents, workers are not provided with fall protection. Unfortunately, construction companies will almost never accept responsibility if someone is injured during the course of any project. This is why it is so important that these incidents are thoroughly investigated by an outside party.
