FALMOUTH, MASSACHUSETTS (September 8, 2028) – Several people were injured in a Falmouth car accident with a box truck by the intersection of John Parker Road and East Falmouth Highway (Route 28).
Barnstable County officials are saying that the accident took place around 2:30 PM on Tuesday. A box truck and two cars were involved in a head-on collision for undetermined reasons.
Paramedics and first responders were called to the scene of the collision to help all the victims. At least one driver was transported to Falmouth Hospital in a medical helicopter.
Authorities advised officials to avoid East Falmouth Highway as they work to clean up the crash site. A full investigation into the cause of the accident remains ongoing at this time.
Liability for Falmouth Box Truck Accidents
All drivers must use caution to avoid collisions with other vehicles. This necessitates that they maintain a safe speed at all times and scan the road ahead for hazards. Pursuant to M.G.L. c. 90, § 17, “No person operating a motor vehicle on any way shall run it at a rate of speed greater than is reasonable and proper, having regard to traffic and the use of the way and the safety of the public.” There are a number of ways that a driver may have acted negligently and contributed to a head-on collision.
- Unsafe Lane Changes: A driver may have allowed their vehicle to drift into opposing lanes of traffic.
- Driver Distraction: A driver may have been distracted while operating their vehicle.
- Blind Spots: A driver may have failed to check their blind spots before making a turn at an intersection.
- Driver Intoxication: Drivers may have taken medications or other substances that impaired their ability to operate a vehicle safely.
If a driver enters opposing lanes of traffic and collides with another vehicle, this could form the basis of a negligence claim. It is essential that evidence be properly preserved after any truck accident. Photos of the accident can help reveal what may have gone wrong. Victims should keep in mind that other drivers and their insurance providers will often do everything in their power to deny responsibility for any crash.
Additional Liable Parties for Truck Accidents
Truck accidents are often highly complex events. The factors that contribute to truck accidents could take place hours, days, or weeks before the actual accident. Depending on the facts of any case, there could be several liable parties for any truck accident. What follows are just a few parties that could be held responsible for a commercial trucking accident.
- Truck Manufacturer: The company that manufactured a truck could be responsible if it was caused by some type of design defect. In particular, a tire blowout could cause a truck driver to lose control and veer into opposing lanes of traffic.
- Truck Company: The company that owned or operated the truck could be liable for the negligent actions of their driver. In general, employers in Massachusetts can be held vicariously liable for the wrongful actions of their workers.
- Other Drivers: If multiple vehicles are involved in a collision, several drivers could be liable. This is particularly true if one driver pushed a vehicle into opposing lanes of traffic.
Even if a driver is partially at fault for a car accident, they can still recover damages through a civil claim. Massachusetts is one of many states that adjudicates claims on the basis of comparative negligence. Any person injured in a truck accident may be able to seek some measure of accountability and justice through a personal injury claim. Damages in a civil claim can help cover lost wages, medical bills, and pain and suffering.
