FOXBOROUGH, MASSACHUSETTS (November 17, 2025) – A construction worker identified as David Wachinski was seriously injured in a Foxborough, Massachusetts car accident on Interstate 95 North.

Norfolk County officials are saying that the accident took place around 2:15 a.m. on Monday. David Wachinski was hit by a vehicle on the northbound side of the highway as he was retrieving a sign.

Troopers arrived at the scene of the accident and put a tourniquet over the victim’s leg. He was then transported to Boston Medical Center with serious injuries.

Unfortunately, David Wachinski lost part of his leg as a result of the crash. You can help support his recovery through GoFundMe.

According to the online fundraiser, “David is a devoted husband and the proud father of two amazing boys. Anyone who knows him knows how hard he works to provide for his family and how quick he is to lend a hand to others. Now, it’s our turn to rally around David and Katie as they face this incredibly difficult time.”

Liability for Foxborough Car Accidents

Every driver has a legal obligation to exercise due care to avoid colliding with pedestrians and road workers. This necessitates that they travel at a safe speed. Pursuant to 17 (M.G.L. c. 90 § 17), “No person operating a motor vehicle on any way shall run it at a rate of speed greater than is reasonable and proper, having regard to traffic and the use of the way and the safety of the public.” Construction companies should take several measures to protect their workers from car accidents.

  • Advanced Warning: Construction companies should place advanced warning systems that let people traveling down the freeway know that there is roadwork ahead.
  • Taper Lengths: Construction companies should ensure that all work zones are preceded by proper taper lengths and smooth lane transitions. This is particularly important when work is being performed at night.
  • Proper Visibility: Construction companies should ensure that work zones are properly lit. They should install sufficient lights in work zones and reflective cones and barrels.

When a worker is injured in a Massachusetts freeway accident, they will typically have recourse through the workers’ compensation system. This is a no-fault insurance scheme designed to help workers. There is no need for an injured worker to demonstrate that one party acted negligently. In addition to workers’ compensation, An injured worker may be able to seek support through a third-party liability claim. A third-party liability claim may be possible if an entity separate from a worker’s employer contributed to an accident.

Third-Party Liability for Massachusetts Work Zone Accidents

Car accidents remain one of the leading causes of preventable injury and death for construction workers. According to the National Safety Council, “In 2023, 898 people were killed and 40,170 people were injured in work zone crashes. Work zone crashes are defined as taking place within the boundaries of a work zone or on an approach to or exit from a work zone due to activities, behaviors, or controls related to traffic moving through the boundaries of a work zone.” These accidents tend to be complex and may involve several different sources of third-party liability.

  • Driver: The driver that hit a construction worker could be legally responsible for an accident. Drivers are supposed to use caution and slow down when approaching construction zones.
  • General Contractor: A general contractor responsible for overseeing safety at a construction site could bear some responsibility if a worker is struck by a vehicle. They may have failed to provide adequate safety measures, lighting, or barricades to divert traffic away from workers.
  • Municipal Entity: A municipal entity like a county or state responsible for a stretch of road could be legally responsible for an accident as well. This may be the case if the accident was caused by a dangerous condition on public property.

Construction zones on freeways can be incredibly dangerous. However, many of the accidents that occur at these sites are preventable when the right safety measures are taken. But in far too many situations, OSHA guidelines are not completely followed. This can put workers and the general public at risk. Any worker that is injured at a construction zone in Massachusetts may be able to seek some measure of justice and accountability through a personal injury claim.
