If the road conditions were caused by a specific thing, if the road has been dug up by a construction crew and there weren’t proper warnings, yes, you absolutely can make a claim.
One good instance, I’ve got a client right now who he was about 16, 17 at the time, riding his bike on the sidewalk. A construction crew had been working on the street. They had cut a trench across the street and into the sidewalk. There were no cones, the construction at that point, they had finished up for the night, so there weren’t any active workers. And, there’s this ditch about 2ft wide in the sidewalk where he had absolutely no warning.
Bicycle hit the ditch, he went over, fell on his face. So, yes, in certain circumstances you can make a claim for injuries if you’re riding a bicycle because of road conditions. However, if it’s a natural condition, naturally occurring condition, even something like a pothole, you need to be a reasonable person when you’re walking, riding a bike, driving a car. So, if you do get in an accident with your bicycle, again, documentation is very important.
Pictures, pictures of the area, where did you fall. If there’s a road crew nearby, take a picture of their faces and also take a picture of their vehicle. You need the name of the construction company. Phone number is always helpful.
