Massachusetts car insurance requirements, we have something called compulsory limits, which means in Massachusetts, you need to carry at least 25,000/50,000 insurance. 25/50, as we like to call it, means that the most any single individual can recover from an accident is $25,000. The most any group of people can recover is $50,000.
There are also optional limits that you can get. They start at 35, 80. There’s $1,000, $3,000, $250k, $500,000. It’s important to have additional coverage, in my opinion. It was honestly one of the first things that I changed as soon as I started working for an attorney, is I raised my insurance levels.
Personal injury protection and your insurance policy in Massachusetts, your auto insurance policy automatically covers the first $2,000 worth of your medical bills. And, that happens regardless of who’s at fault, what kind of health insurance you have, anything like that. But after that, it kind of splits off.
If you have some sort of state health insurance, federal health insurance, the next $6,000 up to $8,000 will be paid by personal injury protection. So, if you have state or federal, they’ll pay $8,000 worth of medical bills.
If you have private health insurance, medical bills would then go to your health insurance provider. Blue Cross, Tufts, Cigna, something like that. Any co-pays, deductibles, coinsurances can then be submitted back to your personal injury protection for reimbursement.
Unfortunately, you do have to jump through the hoops of getting it through your health insurance. And, it’s important that your medical provider knows what kind of health insurance you have and knows the system. So, if your health providers have any questions, we always encourage our clients to call here at DiBella Law so that we can then help walk the provider through the process in case they need any help.
