Who is Liable for a Truck Accident in Falmouth? Determining Fault
Every truck driver in Massachusetts must use caution and operate their vehicles in a reasonably safe manner to avoid accidents. This requires them to maintain a safe speed at all times. According to Massachusetts General Laws, Chapter 90, § 17, “No person operating a motor vehicle on any way shall run it at a rate of speed greater than is reasonable and proper, having regard to traffic and the use of the way and the safety of the public.” There are many ways that a truck driver may have acted negligently and contributed to a pedestrian collision.
- Follow Distance: A truck driver may fail to maintain a safe follow distance with cyclists or other vehicles ahead of them.
- Turns: A truck driver may fail to check their blind spots before making a turn at an intersection.
- Fatigue: A truck driver may have operated their vehicle without getting adequate rest.
- Scanning: A truck driver may fail to properly scan the road ahead of them for cyclists and other hazards.
If a truck driver fails to slow down to avoid colliding with any cyclist in the roadway, this could serve as evidence of negligence. Truck drivers are supposed to maintain at least three feet of separation with cyclists in bicycle lanes, but this does not always happen. When trucks are involved in a collision, liability could extend beyond any individual driver determined to be at fault. This is particularly true if a box truck was being used for some type of commercial purpose at the time of the crash.
Steps to Take After Falmouth Truck Accidents
Cyclists have a naturally small profile and are more likely to be overlooked by other drivers. According to the National Safety Council, “The number of preventable deaths from bicycle transportation incidents increased by 1% in 2024 and 37% in the last 10 years (from 1,015 in 2015 to 1,392 in 2024). The most recent nonfatal injury data are for 2023.” Certain actions should be taken after any bicycle accident.
- Police: The police should be called to the scene of the accident so that they can begin an investigation. Any report that they create should be collected.
- Medical Records: All medical records related to injuries should also be sought. They can help paint a clear picture of what happened, even in the absence of eyewitnesses.
- Surveillance: Any surveillance footage that may have captured the accident should be sought. Many traffic intersections are covered by cameras.
- Investigation: The family of any person killed in a collision should seek an independent review by a team experienced in negligence claims.
Truck accidents tend to be highly preventable. They are often a consequence of truck drivers that are not paying adequate attention to the road ahead of them. But that’s only one part of the problem. Another major issue is that pedestrian infrastructure has not kept pace as cities and towns have continued to grow. The family of any person who died in a Massachusetts bicycle accident may be able to seek some measure of accountability through a civil action.
