One question that I often get a lot from clients is whether or not you can pursue a claim if you get into a car accident with no insurance where the other drivers at fault. And the answer is yes. You can still pursue a claim. Often times it’s through what’s called uninsured insurance. The at fault driver is still responsible for the harm they caused you. However, in Massachusetts, they might face fines, license suspension for driving uninsured. The bigger issue that you’re going to face is whether or not you have your own what’s called PIP coverage, which is personal injury protection.

That’s going to cover your immediate medical bills. But if the other driver is clearly at fault, their liability insurance, if they had it, should still cover your injuries and damages. Just be prepared for the insurance company to use your lack of insurance against you in negotiations. With the right attorney, we won’t let that happen.
