What are the statute of limitations for a personal injury case? In Massachusetts, that just means how long do you have to actually bring a claim. And, in Massachusetts, it’s going to be three years from the date of the injury or the accident. That’s the standard deadline. And make sure you don’t wait.

There are some exceptions that can shorten this. So, you do want to make sure that you talk to an attorney to verify.

Certain claims against government entities require written notice within 30 days and formal filing within two years.

A medical malpractice does have three year limits, but there’s something called the discovery rule, which is when you knew or should have known that the act occurred. And that could have a total limit of seven years.

In most cases, in Massachusetts, if there’s a minor, it’s going to be three years from the date that they turn 18.

But here’s why waiting right to the end can hurt you: evidence is going to disappear, witnesses forget details, and insurance companies will argue that the delay meant you weren’t really hurt.
