Determining Liability in Raynham Industrial Accidents: Seeking Compensation for Workplace Injuries
Employers have a legal obligation to maintain their premises in a reasonably safe condition. This necessitates that there are not open and obvious hazards that could cause serious injury to a worker. Workers should be provided with all of the training necessary to perform their jobs. They should also receive all of the personal protective equipment (PPE) that they need. There are many ways that a metal fabrication plant may fail to protect workers from injury.
- Machine Guarding: A metal fabrication company may have removed guards. This can place a worker’s limbs in harm’s way.
- Lockout/Tagout: A metal fabrication company may not have properly de-energized a machine before maintenance.
- Supervision: A metal fabrication company may have allowed workers to operate dangerous machinery without proper training or supervision.
When a worker is injured in Massachusetts, they will typically have recourse through the worker’s compensation system. Most employees will be fully entitled to worker’s compensation, regardless of how an accident took place. It operates on a no-fault insurance model. In addition to worker’s compensation, an injured worker may also be able to receive aid through a third-party liability claim. A third-party liability claim may be possible if an entity separate from a worker’s employer contributed to the accident.
Investigating Raynham Industrial Accidents: Securing Proof of Negligence and Liability
The metal manufacturing industry remains quite high-risk with many reported injuries each year. According to the Metal and Fluid Recycling Minute, “Data compiled by the Occupational Safety and Health Association (OSHA) shows that the number of metalworking injuries per 100 people is higher than in all private industries and construction.” Metal fabrication can be a highly complex process that requires coordination among several people. Accordingly, there could be several sources of third-party liability for any industrial accident.
- Equipment Manufacturer: The company that manufactured a piece of equipment and a metal fabrication plant could be liable for an accident through a product liability claim. This may be possible if a piece of machinery lacked proper guards or other safety features.
- Maintenance Contractors: The company responsible for maintaining a piece of equipment and metal fabrication plant can also be liable for an accident. They may have failed to reinstall safety guards after performing maintenance or other work.
- General Contractors: A general contractor could be liable for an accident in a metal fabrication plant if they fail to maintain any worksite in a reasonably safe condition.
Industrial accidents can be extremely traumatic and consequential for affected workers. Many victims need to take extensive periods of time away from their profession. In many cases, they may not be able to return to their previous jobs. Any person injured in an accident at a metal fabrication plant may be able to pursue some measure of accountability for a civil claim.
