Who is Liable for Industrial Accidents on New Hampshire Job Sites?
Employers must use a great deal of care to protect workers from foreseeable sources of harm. When an employer has actual or constructive notice of a dangerous condition on their premises, they must take action. Following safety precautions is especially important for any business that performs metal fabrication. What follows are a few reasons that accidents may occur during metal fabrication.
- Machines: Heavy machinery at a metal fabrication plant may have missing guards or other safety measures.
- Falling Materials: Workers are highly susceptible to being hit by falling beams and other materials if they are not stacked properly.
- Electrical Hazards: A worker could be exposed to electrical hazards if equipment is not properly grounded.
- Communication: A lack of adequate communication between workers can create major hazards that put everyone at risk.
When a worker is injured in New Hampshire, they will typically be able to recover damages through the workers’ compensation system. This is a no-fault insurance scheme. An injured worker may also be able to pursue damages through a third-party liability claim. A third-party liability claim may be possible if an entity separate from a worker’s employer contributed to an accident.
Third Party Liability for New Hampshire Industrial Accidents
Jobs in metal fabrication can be extremely dangerous. Many workers are seriously injured each year. According to the Metal and Fluid Recycling Minute, “Data compiled by the Occupational Safety and Health Association (OSHA) shows that the number of metalworking injuries per 100 people is higher than in all private industries and construction.” There could be several sources of liability for any accident at a metal fabrication facility.
- Material Handling Contractors: A metal handling contractor could be liable for an accident if they improperly rigged a steel beam that fell and injured someone.
- Equipment Manufacturer: An equipment manufacturer could face liability for an accident if that equipment lacks safety interlocks or load-stability systems.
- Steel Supplier: The company responsible for packaging steel beams could be liable if they improperly bundled those beams in a way that caused them to become unstable.
It can be hard to move forward after any industrial accident. Workers are often left with very serious injuries that impair their ability to work. They could also be left with high medical bills. Any person injured in a workplace accident may be able to pursue damages through a civil claim. A personal injury attorney can examine the unique facts of your case free of cost and let you know what your legal options are.
