A full investigation into the circumstances surrounding the collision remains ongoing at this time.

Identifying Liable Parties in a Massachusetts Dump Truck Accident

Dump truck drivers must operate their vehicles with an abundance of caution to avoid causing harm to other drivers. This necessitates that they continuously scan the road ahead of them and maintain a safe speed at all times. Pursuant to 17 (M.G.L. c. 90 § 17), “No person operating a motor vehicle on any way shall run it at a rate of speed greater than is reasonable and proper, having regard to traffic and the use of the way and the safety of the public.” There are many other ways that a truck driver may have acted negligently prior to a collision.

  • Distracted Driving: A truck driver may be distracted by their phone or GPS.
  • Blind Spots: A truck driver may fail to check blind spots before making a turn at the intersection.
  • Inclement Weather: Poor weather conditions can affect vehicle traction and visibility, both of which can make car accidents more likely.
  • Fatigue: Truck drivers may fail to be well rested prior to any collision.

If a truck driver makes an unsafe movement that contributes to a collision, this could serve as evidence of negligence. Even if a truck driver were only partially at fault for a traffic collision, this would not shield them from legal responsibility in the event of a legal claim. Moreover, the company that a truck driver worked for could also bear some legal responsibility for the crash. As a general rule, employers within the state of Massachusetts can be vicariously liable for the negligent actions of their workers who are operating within the course and scope of their job duties.

Critical Steps to Take After a Dump Truck Accident in Swansea, MA

Dump trucks can weigh tens of thousands of pounds and can be extremely dangerous even at lower speeds. The number of serious dump truck collisions has increased over recent years. According to the Engineering News Record, “Serious accidents involving dump trucks and ready-mix concrete delivery trucks continue to edge up, part of a persistent, multi-industry problem with poor driving habits that has not yet responded to increased fleet and vehicle insurance premiums.” Certain steps should be taken after any dump truck accident.

  • The police report for the accident should be sought and carefully reviewed. It can offer a great deal of insight into what happened in the moment leading up to a crash.
  • All of the medical records related to the collision should be reviewed. The nature of a person’s injuries can help paint a clear picture of what happened, even in the absence of other forms of evidence.
  • The purpose of a truck driver’s trip should be scrutinized. It matters whether or not they were working at the time of a crash.
  • The family members of any person killed in a collision with a dump truck should request an independent review by a team experienced in accident reconstruction and negligence claims.

Truck accidents tend to be highly complex events. Several different factors may contribute to a collision. This could include poor infrastructure and confusing traffic signs. Car accidents tend to be highly concentrated along specific roads and intersections. It is important that the victims of truck accidents or their surviving family members understand that they do have legal options. The family of any person who died in a collision may be able to pursue some measure of accountability through a civil claim.
