Elderly Victim Suffered Catastrophic Physical and Brain Injuries After Crash Involving Amazon Delivery Van in 2024
BOSTON, MASSACHUSETTS (July 30, 2026) – A Massachusetts jury has awarded $56 million to a 78-year-old man who was catastrophically injured after being hit by an Amazon delivery van.
The court case stems from a crash that took place in 2024. A driver sustained life-threatening injuries in Portsmouth after a three-vehicle crash involving an Amazon delivery van.
That Amazon delivery driver reportedly fell asleep at the wheel and crossed the center line before hitting the plaintiff’s vehicle. As a result of the collision, the plaintiff suffered a traumatic brain injury, a leg amputation, and other catastrophic injuries.
Attorneys for the injured plaintiff filed a lawsuit against Amazon Logistics, who they argued was vicariously liable for the collision. As is the case with many lawsuits against Amazon, the company argued that they could not be vicariously liable for the collision because the driver responsible for the crash was not a direct employee of Amazon.
Instead, that driver worked for a company identified as Agora Logistics, LLC. This company was an Amazon independent delivery service and was also listed as a co-defendant in the case.
Prior to the start of the trial in July 2026, the Amazon driver admitted that they had caused the accident through negligence. Agora Logistics also conceded that the at-fault driver was operating within the course and scope of their job duties at the time of the crash.
The plaintiff’s attorneys also argued that Amazon should be held vicariously liable for the collision. In particular, Amazon Logistics controlled almost every aspect of the delivery operations, including routes, technology, and driver conduct.
This was true despite the fact that Agora Logistics, LLC calls itself “independent contractors.” Just a week before trial, Amazon filed a stipulation that effectively conceded the question of liability on its part.
The Boston Globe has reported that the $56 million verdict is the largest single-plaintiff verdict in the history of Massachusetts. It is also the largest jury verdict against Amazon.
Liability for Accidents Involving Amazon Delivery Vehicles
Every person operating a motor vehicle in Massachusetts owes a duty of care to the other people they share the road with. Pursuant to M.G.L. c. 90, § 17,”No person operating a motor vehicle on any way shall run it at a rate of speed greater than is reasonable and proper, having regard to traffic and the use of the way and the safety of the public.” There are several ways that any driver may have acted negligently in a crash.
- Follow Distance: A driver may not have maintained a safe follow distance with another vehicle.
- Blind Spots: A driver may not have checked their blind spots before making a turn at an intersection.
- Fatigue: A driver may not have taken periodic rest breaks and become dangerously fatigued during their route.
- Distraction: A driver may have been distracted by their phone or other object prior to the collision.
Accidents involving Amazon delivery vehicles could involve multiple liable parties beyond any specific driver that is determined to have acted negligently. Under common law, delivery companies can be held vicariously liable for the negligent conduct of their employees who were operating within the course and scope of their job duties. Amazon has attempted to evade direct liability for collisions by arguing its delivery service providers are “independent.” But this recent court verdict really calls that into question, given how much control Amazon exerts over every part of those delivery operations.
Factors That Contribute to Amazon Delivery Accidents
Far too many people have been seriously injured or killed every year in preventable accidents involving Amazon delivery drivers. According to one investigation by ProPublica, “Amazon’s promise of speedy delivery has come at a price, one largely hidden from public view. An investigation by ProPublica identified more than 60 accidents since June 2015 involving Amazon delivery contractors that resulted in serious injuries, including 10 deaths.” Several factors may contribute to Amazon delivery accidents.
- Insufficient Rest Times: Many Amazon delivery drivers are simply not given adequate time to rest and take bathroom breaks during the day. This can lead to increased fatigue and reduced coordination.
- Aggressive Schedules: Aggressive delivery schedules created by Amazon can encourage drivers to speed or take other shortcuts to complete deliveries.
- Driver Screening: Many Amazon delivery drivers are relatively inexperienced before they’re placed on incredibly demanding routes. This is a recipe for disaster.
- Distracted Driving: Amazon delivery drivers often have to balance keeping their eyes on the road with responding to dispatch communications during the course of their routes. Any driver could easily become distracted in these circumstances.
The pressure to deliver for Amazon can be intense. In fact, it has been relatively common for Amazon drivers to resort to peeing in bottles to keep up with algorithmic delivery quotas. This has arguably led many drivers to adopt unsafe driving habits that put everyone else on the road at risk.
