Boy Survives Falling Over 60 Feet Out of a Window at the Lincoln Village Apartments in Worcester

WORCESTER, MASSACHUSETTS (April 21, 2026) – A 4-year-old boy was injured after falling from a seventh-floor window at the Lincoln Village Apartments in Worcester.

Worcester Police Department officials are saying that the incident took place around 7:30 p.m. on Wednesday, April 15. The child fell and landed onto a bed of mulch that absorbed some of the impact.

Firefighters and paramedics were called to the scene of the accident to help the child. He was reportedly conscious and breathing by the time first responders arrived.

That child was transported to a hospital and is expected to survive. Neighbors were amazed that the child was able to survive the fall.

Both parents were home at the time that the accident took place. A full investigation into the circumstances surrounding the accident remains ongoing at this time.

Understanding Landlord Liability and Massachusetts Window Guard Laws in Worcester

Property owners in Massachusetts have a legal obligation to maintain their premises in a reasonably safe condition. This necessitates that they abide by all fire and building codes. If a property owner has actual or constructive notice of a dangerous condition on their premises, they must take action. Failing to take action to remedy a dangerous condition could create the basis of a negligence claim. Property owners should take several measures to protect children from window fall accidents.

  • Window Guards: Property owners should install window guards on units that have small children.
  • Window Bars: Property owners can also install window bars that prevent children from falling out, even when the window is open.
  • Maintenance: Property owners should ensure that air conditioning units are properly installed and secured.

When a property owner fails to install window guards at a unit with children, this creates the foreseeable risk that the child could fall through the window. A number of landlords have faced lawsuits after children were injured in window fall accidents across Massachusetts. In particular, a landlord could be liable for a window fall accident if they knew that a window screen was not properly secured and failed to remedy that condition.

4 Critical Items to Seek Following a Window Fall Accident

Falls remain a major cause of preventable injury and death for children across Massachusetts and the United States. According to the Journal of Trauma and Acute Care Surgery, “Falls accounted for 5.9% of the childhood deaths due to trauma in a review of the medical examiner’s files in a large urban county. Falls represented the seventh leading cause of traumatic death in all children 15 years of age or younger, but the third leading cause of death in children 1 to 4 years old.” Parents should take several actions if their child has been injured in any type of window fall accident.

  • Medical Support: Parents should seek medical support for their children as early as possible. All of the medical records related to that treatment should be preserved.
  • Maintenance Records: All of the maintenance records related to the window involved in the accident should be collected.
  • Accident Reports: It should be determined if there has been a history of similar accidents at the property in question.
  • Legal Review: Parents should seek the guidance of a team experienced in premises liability claims. An attorney can determine whether or not a landlord or some other entity could be legally responsible for the accident.

Window fall accidents are often highly preventable. Landlords should install window guards and take other safety precautions to prevent these incidents. But far too often this does not take place. It is important the parents of children injured in these accidents understand that they do have legal rights. They are able to seek some measure of accountability through a civil action.
