Determining Liability in New Hampshire Car Accidents: Who Is at Fault?

Drivers must use caution to avoid hitting pedestrians and other vehicles. This requires that they abstain from alcohol and other drugs. According to NH Rev Stat § 265-A:2, “No person shall drive or attempt to drive a vehicle upon any way or operate or attempt to operate an OHRV: (a) While such person is under the influence of intoxicating liquor or any controlled drug, prescription drug, over-the-counter drug, or any other chemical substance.” There are many other ways that a driver may have acted negligently prior to hitting any pedestrian.

  • Speeding: A driver may have been traveling too fast for the prevailing road conditions.
  • Blind Spots: A driver may have failed to check their blind spots while turning at an intersection.
  • Aggressive Driving: A driver may have lost control of their vehicle by making sharp turns or otherwise driving aggressively.

If a driver fails to slow down to avoid colliding with any pedestrian on the roadway, this could serve as evidence of negligence. Drivers should be particularly cautious around pedestrians. When drivers cause a car accident while intoxicated, they could also face criminal charges for their actions. Even very modest amounts of alcohol can substantially impair a person’s ability to operate a vehicle safely.

Steps to Take After Hillsborough County Car Accident

Driver intoxication remains a major cause of preventable car accidents across New Hampshire and the United States. According to the National Highway Traffic Safety Association, “Every day, about 32 people in the United States die in drunk-driving crashes — that’s one person every 44 minutes. In 2024, 11,904 people died in alcohol-impaired driving traffic deaths.” It is important that several actions are taken after any DUI collision.

  • The police report for the crash should be sought.
  • Any person that may have witnessed the collision should be interviewed.
  • All of the physical evidence captured after the crash should be collected.
  • Photos of the accident site should be taken.
  • The family of any person who died in a DUI accident should seek an independent review by a team experienced in accident reconstruction.

DUI accidents are entirely preventable. By the time many drivers are eventually arrested for DUI, they likely drove while intoxicated on a number of different occasions. The victims of these collisions are protected by a number of laws. They are able to seek some measure of accountability through a civil claim. This right extends to the surviving family members of any person who died in a crash.
