Liability for West Bridgewater Rollover Accidents
Under Massachusetts General Laws, Chapter 90, § 17 (M.G.L. c. 90, § 17), “No person operating a motor vehicle on any way shall run it at a rate of speed greater than is reasonable and proper, having regard to traffic and the use of the way and the safety of the public.” The same law requires drivers to slow down when a special hazard exists, including by reason of weather or highway conditions.
Courts will consider a number of factors when evaluating liability for any rollover accident.
- Speed: Investigators may look at whether the vehicle was traveling at a speed that was reasonable for traffic, weather and road conditions.
- Other Vehicles: Witnesses and debris can show whether another driver cut off, sideswiped or forced the vehicle off the road.
- Road Conditions: Potholes, uneven pavement, missing guardrails or poor drainage may have contributed to a loss of control.
- Vehicle Condition: Tire failures, steering problems or other mechanical defects can cause a vehicle to leave the roadway and roll.
Many rollover crashes involve only one vehicle, but that does not always mean the driver alone is responsible. A driver who forces another vehicle off the road by drifting out of a lane or making an unsafe lane change may be found negligent. Depending on the facts, a vehicle or tire manufacturer could also be held responsible for a defective part, and the party responsible for maintaining the roadway may share liability for a dangerous condition.
Preventing Rollover Crashes on Massachusetts Highways
Far too many people are seriously injured or killed every year in preventable rollover accidents. According to one report by the Insurance Institute for Highway Safety, “In 2024, rollover crashes accounted for 20% of occupant deaths in cars, 38% of occupant deaths in pickups, and 33% of occupant deaths in SUVs.”
Drivers can lower their risk of a rollover by taking a few simple precautions:
- Slow Down: Adjust speed for curves, wet pavement and low light, especially on highways like Route 24.
- Avoid Overcorrecting: If a vehicle drifts onto the shoulder, steer back gently rather than jerking the wheel.
- Buckle Up: Seat belts help keep occupants inside the vehicle and protected if it rolls.
- Maintain Tires: Keep tires properly inflated and replace worn tread to help keep control of the vehicle.
- Stay Alert: Put the phone away and pull over if drowsy, since many rollovers begin when a vehicle drifts off the road.
When another driver’s carelessness, a defective vehicle part or a dangerous road condition contributes to a rollover crash, the people who were hurt may be able to seek some measure of accountability through a personal injury claim.
