Liability for Hanson Apartment Accidents
Property owners in Massachusetts have a legal obligation to maintain their premises in a reasonably safe condition. Consider, for example, Smith v. Arbaugh’s Restaurant, Inc. The court held property owners owe a duty to use reasonable care to keep their premises “in a reasonably safe condition in view of all the circumstances, including the likelihood of injury to others, the seriousness of the injury, and the burden of avoiding the risk.” There are several measures that property owners should take to avoid accidents where children fall from apartment windows.
- Window Guards: Property owners should install window guards on windows above the first floor.
- Window Stops: Property owners should install window stops that prevent windows from being opened beyond a certain level.
- Window Locks: Property owners should ensure that window locks are periodically inspected and maintained.
- Furniture: Property owners should ensure that climbable furniture is not placed near windows.
If a property owner fails to take reasonable measures to protect children from falling out of windows, this could serve as evidence of negligence. In particular, property owners must take action when they have actual or constructive notice of a dangerous condition on their premises. When there is a history of similar accidents at a particular location, this makes additional incidents foreseeable. It is also possible that a property owner could be liable by creating a dangerous condition that allowed a child to fall through a window.
Common Injuries Associated With Window Fall Accidents
Falls are one of the most common causes of preventable injury and death for young children. According to Stanford Medicine, “Young children are curious and will explore an open window. Windows that are open just 5 inches pose a danger to children. Falls from windows tend to be the most severe. In some cases, these falls can cause death. A closed window can also be dangerous if the child can get near it.” There are many different injuries associated with window falls.
- Even falling from a short distance can cause major fractures and open wounds.
- Another major injury commonly associated with window falls is spinal cord injuries. These can result in temporary or permanent paralysis.
- Depending on how a person lands, they are also at risk of sustaining a head injury. Even a moderate concussion can have long-term neurological health implications.
- Victims of falls are also at risk of major internal trauma. Not all of the internal injuries and organ damage that a person sustains will be outwardly obvious.
Window falls tend to be preventable in many different situations. Window guards can go a long way towards preventing most of these accidents. Unfortunately, property owners will almost never accept responsibility if a child is injured on their property. The parents of any child injured in a window fall should carefully consider their legal options with a team experienced in personal injury claims. Damages in a civil claim can help cover lost wages, medical bills, and pain and suffering.
