Liability for New Hampshire Motor Vehicle Collisions
It is illegal in New Hampshire to drive a vehicle while under the influence of alcohol or other intoxicating substances under RSA 265-A:2. In particular, drivers must not have a blood alcohol concentration of 0.08% or higher. Drivers can also be liable for accidents caused by the unsafe operation of their vehicle through intersections. Courts will consider a number of factors when evaluating liability for any car accident.
- Traffic footage that captured the drivers’ movements leading up to a crash will be reviewed.
- Any blood alcohol test that indicated a driver was intoxicated will also be considered.
- The speed of all vehicles prior to the collision should be considered as well.
- It also matters whether or not any driver was working at the time of a collision.
There is a presumption of negligence on the part of any driver that goes past a yield sign without stopping. Depending on the unique facts of any case, liability for a motor vehicle collision could extend to several other parties beyond any driver determined to be at fault. New Hampshire law provides that employers can be vicariously liable for the negligent conduct of their workers who were operating within the course and scope of their job duties. This includes situations where a work vehicle was being used to transport materials or for some other official task.
Preventing DUI Accidents and Seeking Accountability
Driver intoxication remains one of the leading causes of preventable car accidents across New Hampshire and the United States. According to one report from the National Highway Traffic Safety Administration, an estimated 11,904 people died in alcohol-impaired crashes across the United States in just the year 2024 alone. What many people do not realize is that there are a number of substances besides alcohol that could potentially impair a person’s ability to operate their vehicle safely. Multiple actions should be taken to prevent DUI collisions.
- People should arrange to have a sober driver take them to their destination if they do plan on drinking.
- Workers should consult with their doctors and pharmacists about whether or not any medication can impair their driving.
- Employers should have clear policies related to drinking and work tasks.
- Cities should heavily enforce traffic violations associated with intoxicated driving.
DUI collisions are nearly always preventable. They are almost entirely the consequences of people who have made poor judgments about their ability to drive safely while intoxicated. Unfortunately, negligent drivers and their insurance providers are not likely to accept responsibility after any collision causes someone to be seriously injured. This is why it is so important that victims carefully consider their legal options with an experienced DUI accident attorney.
