Liability for Assaults Involving Uber Drivers
Uber drivers owe a duty of care to their passengers. They must transport their passengers without exposing them to any type of foreseeable risk of harm. Uber and other rideshare drivers can be held personally responsible if they were to assault any person they are transporting. Liability can also extend to Uber or another rideshare company if their own conduct somehow contributed to the incident. In particular, Uber may be responsible under the legal theory that they negligently retained an assailant who went on to harm a passenger. There are several elements that will typically need to be shown for any claim of negligent retention involving a rideshare driver.
- Qualifying Relationship: The defendant employed or otherwise retained sufficient control of the person who caused harm to the plaintiff.
- Unfit Nature: The driver involved in the assault was unfit for their position due to behavioral or safety issues that made them unable to safely transport passengers.
- Notice: The defendant had actual or constructive notice that the worker was unfit for their position. This could come in the form of prior complaints about the driver’s behavior.
- Failure to Respond: The defendant failed to take appropriate action after receiving notice of the assailant’s unfit nature. In other words, they may have failed to investigate, monitor, or suspend the driver involved.
- Proximate Cause: The defendant’s failure to appropriately respond to warning signs related to the assailant was the proximate cause of the plaintiff’s injury.
When evaluating whether or not Uber could be liable for an incident, it matters whether or not they knew or should have known about information that showed one of their drivers was unreasonably dangerous. If, for example, an Uber driver had a history of outbursts involving passengers or was otherwise displaying erratic behavior, this can put Uber on notice. One of the main issues with Uber is that their background checks have been far from thorough in many cases. There has been at least one instance where a terror suspect worked for some period as an Uber driver.
Steps to Take After Being Assaulted by an Uber Driver
Assaults involving Uber drivers are relatively common and a foreseeable outcome that Uber must protect against. Uber has taken some actions to help improve safety. According to Reuters, “Uber is rolling out features that would allow its drivers to see “verified” badges on customer profiles and record trips on their smartphones instead of a dashcam, the ride-hailing firm said on Tuesday. This is expected to improve safety of drivers and comes against the backdrop of a 2021-22 safety report, by Uber that said 31% of sexual assault incidents were reported by drivers against riders, while 68% were reported against drivers.” Multiple actions should be taken after any assault involving an Uber driver.
- Police: The police should be notified of the incident as early as possible so that they can begin an investigation and take steps to preserve evidence.
- Medical Evaluation: Victims should seek a medical evaluation as soon as they can. Many of the injuries associated with an assault will not be immediately obvious.
- Driver History: The history of misconduct allegations against the driver involved should be thoroughly investigated.
- Legal Support: Any person assaulted by an Uber driver should carefully consider their legal options with a team experienced in personal injury claims.
Uber has a relatively high turnover rate. Drivers might choose to work for them for a few months before moving on to another gig or job. The company has to consistently find new workers to replace outgoing drivers. Unfortunately, this has led to situations where many people who arguably should never have been allowed to drive were allowed to drive. Victims of assault by Uber drivers are protected by a number of laws. They are able to seek some measure of justice and accountability through a personal injury claim.
