Driver Identified After Man Was Fatally Struck by Dump Truck on I-93 North Near Exit 34 in Wilmington
WILMINGTON, MASSACHUSETTS (October 6, 2026) – A man has tragically died in a Wilmington hit-and-run truck accident on Interstate 93 northbound near Exit 34.
Massachusetts State Police officials are saying that the collision occurred shortly after 2 PM on Monday, October 5. State and local police responded to a report of a person in the roadway who had been hit by a truck.
The man died from his injuries. Officials have not released his name, and it remains unclear why he was in the roadway.
The truck did not remain at the scene. Investigators described it as a black and red vehicle with a dump truck body. On Tuesday morning, the Middlesex District Attorney’s Office confirmed that the truck had been found and the driver identified. No charges have been filed, and the driver has not been publicly named.
The three right lanes of the highway were closed for several hours while investigators worked at the scene.
A full investigation into the circumstances surrounding the collision remains ongoing at this time. The State Police Collision Analysis and Reconstruction Section, Crime Scene Services, and the State Police Detectives Unit are investigating along with Wilmington police and the Middlesex District Attorney’s Office. Liability for Wilmington Hit-and-Run Accidents
Massachusetts law requires drivers to watch out for people on the road. Pursuant to Massachusetts General Laws, Chapter 90, § 14 (M.G.L. c. 90, § 14), “Upon approaching a pedestrian who is upon the traveled part of any way and not upon a sidewalk, every person operating a motor vehicle shall slow down.” Drivers who strike someone must also stop and identify themselves. Under M.G.L. c. 90, § 24, leaving the scene of a crash that results in a death is punishable by up to 10 years in state prison. Courts will consider a number of factors when evaluating liability for any pedestrian accident.
- Visibility: It matters whether the person in the roadway could be seen from a safe distance, given the lighting, weather, and traffic at the time.
- Speed: The speed of the truck and whether the driver slowed down as the law requires will be closely reviewed.
- Driver Attention: Phone records and other evidence can show whether a driver was distracted in the moments before a collision.
- Work Records: It also matters whether the dump truck driver was working at the time of the crash.
A driver who fails to slow down for a person in the roadway may be found negligent, even when that person was somewhere they were not expected to be. Under Massachusetts’ comparative negligence law, M.G.L. c. 231, § 85, a victim’s own negligence does not bar recovery as long as it was not greater than the negligence of the people being sued, though any damages are reduced in proportion. Liability could also extend beyond the driver. If a truck driver was operating within the scope of their job, the company that employed them could potentially be held responsible as well.
Preventing Hit-and-Run Pedestrian Accidents and Seeking Accountability
Far too many people are seriously injured or killed every year in preventable accidents involving pedestrians. According to the NHTSA, “7,080 pedestrians were killed in traffic crashes in 2024.” Hit-and-run drivers are involved in a large share of these deaths. One NHTSA report found that “Nearly 1 out of every 4 pedestrians killed in traffic crashes in 2023 (24%) were struck by hit-and-run drivers.” There are a number of measures that can help prevent these tragedies.
- Stopping: Any driver who strikes a person should stop, call 911, and stay at the scene. Fast medical care can be the difference between life and death.
- Lookout: Drivers should scan the road and shoulders ahead, particularly on highways where disabled vehicles and stranded motorists are common.
- Fleet Technology: Companies that operate dump trucks and other heavy vehicles can use cameras, GPS tracking, and collision-warning systems that help drivers spot hazards and document what happened.
- Training: Trucking and construction companies should train drivers on large-vehicle blind spots and on their legal duty to stop after any collision.
- Highway Safety: Anyone stranded on a highway should stay inside their vehicle or behind a barrier if possible and call 911 for help.
Hit-and-run crashes are especially painful for families because they leave so many questions unanswered. When a driver leaves the scene, critical evidence can be lost and medical help can be delayed. The family of any person killed due to the negligent actions of another driver may be able to seek some measure of accountability through a wrongful death claim.
