Liability for Manchester Dump Truck Accidents

Dump truck drivers are required to obtain a commercial license. This necessitates that they operate with a great deal of caution to avoid colliding with other vehicles or pedestrians that they encounter. According to NH Rev Stat § 265:143-a, “Every driver of a vehicle, when approaching a bicyclist, shall insure the safety and protection of the bicyclist and shall exercise due care by leaving a reasonable and prudent distance between the vehicle and the bicycle.” Dump truck drivers should take several other actions to avoid collisions with cyclists.

  • Horn: Dump truck drivers should use their horns to alert pedestrians of their presence.
  • Blind Spots: Dump truck drivers should be mindful of their blind spots at all times. This is particularly important when any dump truck is making a turn at an intersection.
  • Spotter: Dump truck drivers should use a spotter if they are backing up or making other risky maneuvers where their visibility is limited.
  • Speed: Dump truck drivers must operate their vehicle at a safe speed at all times and take into consideration the prevailing traffic conditions.

If a dump truck driver does not slow down in time to avoid hitting any pedestrian in the roadway, that driver could be liable for the accident through a civil claim. Even if a pedestrian is outside of a crosswalk or stationary in the roadway, drivers must still use caution to avoid any crash. Liability for any collision with a dump truck or other commercial vehicle could extend to several different parties beyond a driver determined to be at fault. This includes the private employer or municipal entity that a dump truck driver was working for at the time of a crash.

Common Causes of Dump Truck Crashes

Dump trucks are incredibly dangerous and routinely result in serious injuries or deaths. Many of the victims are workers in the construction industry. According to the Centers for Disease Control, “Injuries from dump trucks led to the deaths of 809 construction and extraction workers from 2011 to 2020. Those operating dump trucks or working nearby are at risk of multiple hazards including struck-by, tip-over from loss of vehicle control, crushing, electrical, and falls.” There are several common causes of dump truck collisions.

  • Dump trucks are top-heavy and difficult to control in the best of circumstances. If a dump truck is overloaded or its cargo is improperly balanced, this could cause its driver to lose control and hit a pedestrian.
  • Driver fatigue is another major issue for dump truck drivers. Even staying awake for only 17 hours can dramatically reduce a person’s ability to operate their vehicle safely.
  • Unsafe turns are another major contributing factor to pedestrian accidents. Pedestrians have a naturally small profile and can be easily overlooked by inattentive drivers.

Responsibility for preventing dump truck collisions doesn’t fall entirely on drivers. Cities should also take certain actions to help prevent pedestrian accidents. For example, cities can ensure that traffic intersections are well illuminated so the drivers are able to see pedestrians ahead of them. Victims of dump trucks crashes are protected by a number of laws. In particular, the family of any person who died due to the actions of a truck driver is able to seek some measure of transparency through a civil action.

Investigating Manchester Dump Truck Accidents

We at DiBella Law extend our deepest condolences to the family of Matthew Shattuck. Any person who may have more information about what happened should reach out to the police. City officials should do the right thing and take additional measures to protect pedestrians and cyclists in New Hampshire. Pedestrians and cyclists have often been forced to use roads that have become increasingly hazardous.
