Liability for Cummington Box Truck Accidents
Every driver in Massachusetts must use reasonable caution to avoid colliding with other vehicles on the roadway. This necessitates that they operate their vehicle at a safe speed at all times. According to Massachusetts General Laws, Chapter 90, Section 17, “No person operating a motor vehicle on any way shall run it at a rate of speed greater than is reasonable and proper, having regard to traffic and the use of the way and the safety of the public.” Several other factors could contribute to a truck accident.
- Blind Spots: Trucks have large blind spots that can obscure the presence of smaller vehicles.
- Left Turns: A number of car accidents involve drivers who were making left turns. These are among the most dangerous maneuvers the drivers can make.
- Distraction: Another major contributing factor to truck accidents is driver distraction. Drivers may be looking at their phones or other objects and fail to notice vehicles near them.
If a truck driver turns into the path of another vehicle, this could form the basis of a negligence claim. Liability for any collision involving a commercial truck could extend beyond a truck driver deemed to be at fault. For example, their employer could potentially be liable if they were working at the time of the collision. However, truck companies will typically hire their drivers as “independent contractors” to limit their legal exposure in the event of a crash.
Steps to Take After Cummington Truck Accidents
Certain actions should be taken after any truck accident.
- Treatment: Victims should seek medical treatment as soon as possible. In many cases, injuries associated with a motor vehicle collision will not be immediately obvious.
- Police Report: The police report created for the accident should be sought and carefully reviewed. These reports may contain errors and should therefore be scrutinized.
- Legal Review: Any person affected by a truck accident should contact an experienced truck accident attorney. An attorney can examine the unique facts of any collision and help identify all potentially liable parties.
Car accidents are nearly always the result of some amount of human error. This can include situations where drivers may be traveling too fast for the prevailing road conditions. This is why collisions are more likely to occur in Massachusetts during the winter months. Victims of truck accidents are protected by several laws. The family of any person who died in a truck accident is able to seek some measure of accountability through a wrongful death claim.
Car accidents remain a leading cause of preventable injury and death across Massachusetts and the United States. According to the IIHS, “A total of 40,901 people died in motor vehicle crashes in 2023. The U.S. Department of Transportation’s most recent estimate of the annual economic cost of crashes is $340 billion.”
