Liability for Medford Hazmat Accidents

Under Massachusetts law, property owners owe a duty of care to all lawful visitors that visit their premises. Consider, for example, Kermarec v. Compagnie Generale Transatlantique, 358 U.S. 625, supra, at p. 631. “A landowner must act as a reasonable man in maintaining his property in a reasonably safe condition in view of all the circumstances, including the likelihood of injury to others, the seriousness of the injury, and the burden of avoiding the risk.” There are several steps that hotels should take to prevent hazmat accidents at the property.

  • Storage: Hotels should adequately store all hazardous chemicals in a safe location. This includes any ammonia cleaners, pesticides, or maintenance products. These chemicals should also be properly separated from one another.
  • Handling Chemicals: Only trained workers should be allowed to handle chemicals. This includes situations where chemicals may need to be mixed, diluted, or transferred in any capacity.
  • Disposal: It is common for hotels to generate hazardous materials waste. They must follow all EPA guidelines for the disposal of these materials. Improper disposal could lead to a hazmat situation.

If a property owner failed to take reasonable measures to protect guests from hazardous materials, this could serve as evidence of negligence. Depending on the specific facts of any case, there could be several liable parties for any hazmat accident at the property. For example, a third-party vendor or contractor could bear some level of responsibility for chemicals being released in a property. It is relatively common for hotels to work with a variety of different companies to clean and maintain their property at any given time.

Injuries Associated With Hazmat Accidents

Hazardous chemical leaks are relatively common and pose a serious danger to the public. According to one study in the Annals of Emergency Medicine, “During the four-year study period, 102,177 hazardous chemical incidents occurred in the US, resulting in damages exceeding $1 billion. Approximately 1,033 (1%) were HAZMAT releases that threatened public health. These incidents frequently occurred around transportation corridors and storage facilities.” There are many common injuries associated with hazmat accidents.

  • Respiratory Injuries: Some of the most common injuries associated with these accidents are respiratory injuries. Common symptoms may include shortness of breath, asthma attacks, and wheezing.
  • Chemical Burns: Any type of chemical irritant can cause burns to a person’s skin, eyes, and tissue.
  • Neurological Injuries: Hazardous chemicals can also interact negatively with a person’s brain. This may lead to confusion, disorientation, and tremors. Certain types of solvents are known to negatively impact the central nervous system.

Depending on the severity of a person’s injuries, they may require hospitalization or oxygen treatment. Long-term complications are also a major possibility. The vast majority of hazmat accidents are totally preventable. They tend to be the result of failing to adequately follow safety procedures. Victims of chemical leaks are protected by a number of laws. They’re able to seek some measure of accountability and justice through a civil action.
