Liability for Massachusetts Ladder Fall Accidents
Business owners in Massachusetts have a legal obligation to maintain their premises in a reasonably safe condition. They must supply workers with all necessary safety equipment they need to perform their jobs in a reasonably safe manner. When workers are performing their duties at elevated heights, they will typically need fall protection. Several measures should be taken to prevent ladder fall accidents.
- Ladder Selection: Employer should choose the right ladder for whatever task their workers happen to be performing.
- Inspections: Employers should inspect ladders before every shift.
- Ladder Setup: Employers should train workers how to properly set up and use ladders. Employers should ensure that extension ladders are at a proper angle.
- Footwear: Employers should make sure that their employees have adequate footwear.
When a construction worker is injured in Massachusetts, they will typically have recourse through the workers’ compensation system. This is a no-fault insurance scheme designed to help injured workers. In addition to workers’ compensation, an injured worker may also have recourse through a third-party liability claim. A third-party liability claim may be possible if an entity separate from a worker’s employer contributed to an accident.
Steps to Take After Massachusetts Construction Accidents
Falls remain a leading cause of preventable injury and death for construction workers. Many of these accidents involve workers who fell from ladders. According to the Bureau of Labor Statistics, “In 2020, there were 161 fatal work injuries from which ladders were the primary source. This was a 5.8-percent decline from 2019 (171 deaths). There were 105 deaths specifically from movable ladders in 2020 and 5 deaths from fixed ladders.” Any person injured in a ladder fall should take certain actions.
- Victims should seek medical treatment early on. Many of the injuries associated with a ladder fall are not immediately obvious.
- Victims should let their employers know that they were injured on the job.
- Victims should collect as much evidence as possible related to the accident.
- Victims should carefully consider their legal options with an experienced construction accident attorney.
Any type of ladder fall can have devastating consequences for workers. Many victims will need to take extensive periods of time away from their jobs. To make matters worse, they could also be left with high medical bills. It is important that the victims of construction accidents understand that they do have legal options. They may be able to pursue some measure of accountability through a personal injury claim.
