Who Can Be Held Liable for a Harwich Truck Accident?

Every driver in Massachusetts has a legal obligation to exercise due care and obey traffic laws to avoid collisions. Pursuant to Mass. Gen. Laws ch. 90, § 24(1)(a)(1), it is illegal for any person to operate a motor vehicle while intoxicated by alcohol or any other substance. Even modest amounts of alcohol can seriously impair a person’s ability to operate a vehicle safely.

  • Drivers may experience a decline in visual functions and some loss of judgment while intoxicated.
  • Drivers may have a reduced ability to track moving objects while intoxicated.
  • Drivers may have a difficult time maintaining lane position and braking appropriately while intoxicated.
  • Drivers may have far less muscle control and difficulty concentrating while intoxicated.

If a driver fails to slow down to avoid colliding with another vehicle at an intersection, this could serve as evidence of negligence. When drivers cause a motor vehicle collision while intoxicated, they could also face criminal liability for their actions. Depending on the specific facts of any case, liability for a car accident could extend to several parties beyond any driver determined to be at fault. In particular, a company that owned a truck or other vehicle could be liable if it was being used for some type of commercial purpose.

Steps to Take After A Harwich, MA Truck Accident

Car accidents remain one of the leading causes of preventable injury and death in the United States. A large portion of these collisions involve intoxicated drivers. According to the NHTSA, “Every day, about 32 people in the United States die in drunk-driving crashes — that’s one person every 44 minutes. In 2024, 11,904 people died in alcohol-impaired driving traffic deaths.” Victims of these collisions should take certain actions to protect their health and legal rights.

  • Victims should seek medical attention as early as possible. Many of the injuries associated with a car accident will not be immediately obvious.
  • The police report created after the collision should be sought. It contains an officer’s initial impressions of how a crash took place.
  • Photos of the accident site should be taken. Even still photographs can help reveal how a collision took place.
  • Any person injured in a car accident should seek the legal guidance of a team experienced in personal injury claims.

It is important to act quickly after being injured in a car crash. There is a statute of limitations that must be adhered to. Even before the statute of limitations expires, evidence can disappear. The memories of eyewitnesses can begin to fade. There are numerous benefits associated with seeking legal counsel early on. Any person injured due to the negligence of another driver may be able to seek some measure of justice through a personal injury claim.
