One of my most exciting cases at DiBella Law so far has been a gentleman who worked for a prestigious college. He was riding his bike where he was supposed to be on the road. A gentleman decided to turn into a driveway and just plowed right into my client.
Some of the most important things to consider in this case were we were able to get some street video so we could show exactly how the accident happened. Which is why even if you can’t take video of the accident or get it, taking pictures is so very important.
My client, unfortunately, suffered a traumatic brain injury. He had some difficulty with cognition, fortunately mostly resolved, but he was left with permanent tinnitus. He was unable to do his job the way he used to do it. We fought with the insurance company. TBIs/Traumatic brain injuries can sometimes be very hard to not only diagnose and prove, but then prove a monetary value for the traumatic brain injury.
We did have to go into the court system in this. We filed suit, we went through discovery, and after discovery was completed, we received compensation in the form that my client was very happy with.
