What types of damages does a traumatic brain injury claim cover? We pursue everything the injury has cost you, both economically and personally.

Economic damages include all of your medical bills from the ER to different specialists to imaging and therapy, your future medical care and medication, your lost wages and benefits, to your lost earning capacity if you can’t return to your job, to your different home modifications if any are needed, and your care assistant cost.

Your non-economic damages are going to cover pain and suffering, emotional distress, mental anguish, loss of enjoyment of life, and personality changes that affect relationships.

Your spouse might have what’s called a loss of consortium claim if the injury has fundamentally changed your relationship. A loss of consortium claim allows a spouse or minor child or dependent adult child to sue for non-monetary benefits of that relationship that were lost. These benefits include everything from companionship, comfort, affection, support, shared activities, but not financial losses like wages.

The claim must be brought within the statute of limitations for the underlying personal injury case, though there are certain extensions for minors. Every receipt, every therapy session, every way this injury has changed your life. It all counts.
