New Hampshire is a unique state. They’re one of only three states which there’s no requirement for helmet laws for adult riders. And their state motto is live free or die, which really shows here. If you’re under 18, you must wear a helmet, but adults can choose. Here’s the thing, though. Not wearing a helmet can absolutely impact your injury claim. Insurance companies will definitely argue that your head injuries were preventable.
We can counter this often times by saying that New Hampshire’s law that says you don’t have to wear safety equipment can’t be used as contributory negligence. It still can be an uphill battle, but that’s certainly something we can take head on. My advice is always wear a helmet regardless. But if you don’t and you do get hurt, you still have rights.
